Agreement to Terms

By downloading, installing, or using the Certain mobile application ("the App"), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the App.

Description of Service

Certain is a mobile application designed to help you track and confirm the status of safety-related items in your home, such as locks and appliances. The App allows you to:

Create and manage safety items
Record confirmations when you lock doors or turn off appliances
Attach photos to your items for reference
Review your confirmation history for peace of mind

License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to use Certain for personal, non-commercial purposes, subject to these Terms of Use.

Subscription Terms (Certain Plus)

Certain offers an optional premium subscription called "Certain Plus" with the following features:

Unlimited items (free version is limited to 5 items)
Unlimited photo attachments

Subscription Details:

Monthly subscription: £0.99/month
Annual subscription: £6.99/year
Payment is charged to your Apple ID account at confirmation of purchase
Subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period
Your account will be charged for renewal within 24 hours prior to the end of the current period
You can manage and cancel subscriptions in your App Store account settings
No refunds for the current subscription period

User Responsibilities

You agree to:

Use the App in compliance with all applicable laws and regulations
Not use the App for any illegal or unauthorized purpose
Not attempt to reverse engineer, decompile, or disassemble the App
Not use the App to store inappropriate or illegal content

Important Disclaimer - READ CAREFULLY

CERTAIN IS A RECORD-KEEPING AND REASSURANCE TOOL ONLY. IT IS NOT A SECURITY SYSTEM, SAFETY DEVICE, OR VERIFICATION SYSTEM.

What Certain Does:

Records actions that YOU tell it you have performed
Stores timestamps and optional photos that YOU provide
Displays a log of confirmations that YOU have entered

What Certain Does NOT Do:

Does NOT physically lock doors, turn off appliances, or control any devices
Does NOT verify, confirm, or check the actual status of any item
Does NOT guarantee that doors are actually locked, appliances are actually off, or any action was actually performed
Does NOT monitor your home, detect security issues, or send alerts
Does NOT have any way to know if you actually performed the action you recorded
Cannot prevent theft, fire, accidents, or any other incidents

Critical Understanding: When you tap "Mark as Locked" or "Mark as Off" in the app, you are simply creating a record that says you performed that action. The app cannot and does not verify that you actually locked the door or turned off the appliance. The app only knows what you tell it. If you record that a door is locked when it is not actually locked, the app has no way to detect this error.

YOU ARE SOLELY RESPONSIBLE FOR ACTUALLY PERFORMING ALL SAFETY ACTIONS. The app is a memory aid only, not a replacement for physical verification. Always verify the actual status of safety-critical items in person when necessary.

No Warranty and Limitation of Liability

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

To the fullest extent permitted by law, Certain and its developers shall not be liable for any damages, losses, or harm of any kind arising from or related to:

Your reliance on the app's records or confirmations
Security breaches, burglaries, or unauthorized access to your property
Fires, accidents, or damage caused by appliances left on
Any incident that could have been prevented by proper verification of safety items
Damages resulting from your use or inability to use the App
Loss of data stored on your device
Security incidents, property damage, personal injury, or death
Anxiety, distress, or mental health impacts related to the use of the App
Inaccurate records, false confirmations, or user error
Any other direct, indirect, incidental, consequential, or punitive damages

BY USING THIS APP, YOU ACKNOWLEDGE AND AGREE THAT YOU USE IT ENTIRELY AT YOUR OWN RISK AND THAT THE DEVELOPERS ASSUME NO RESPONSIBILITY OR LIABILITY FOR ANY CONSEQUENCES OF YOUR USE.

Data and Privacy

Your use of the App is also governed by our Privacy Policy. All data is stored locally on your device, and we do not have access to your personal information.

Intellectual Property

All content, features, and functionality of the App, including but not limited to text, graphics, logos, and software, are the exclusive property of Certain and are protected by copyright, trademark, and other intellectual property laws.

Termination

We reserve the right to terminate or suspend your access to the App at any time, without notice, for any reason, including violation of these Terms of Use.

Changes to Terms

We may modify these Terms of Use at any time. We will notify you of material changes by updating the "Last Updated" date. Your continued use of the App after changes constitutes acceptance of the modified terms.

Governing Law

These Terms of Use are governed by the laws of the United Kingdom. Any disputes arising from these terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of the United Kingdom.
